Please read these terms carefully before using Qaf School App

1. Acceptance of Terms

Welcome to Qaf School App ("Qaf", "we", "our", "us"). Qaf is an educational platform designed to serve Islamic schools, teachers, parents, and students with secure, structured access to educational content and communication tools.

By accessing or using our platform, mobile applications, or services (collectively, the "Services"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our Services.

2. Eligibility

Our Services are intended for use by:

  • School Administrators: Authorized representatives of educational institutions
  • Teachers: Educators authorized by their school to use the platform
  • Parents: Legal guardians of enrolled students
  • Students: As permitted by their school. Parental or guardian consent is required for all student accounts regardless of the student's age or jurisdiction.

You must be authorized by a participating school to create an account and use our Services.

3. User Accounts

When you create an account with Qaf, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate and current
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

You agree that Qaf School App is not liable for any data breaches or unauthorized access resulting from your own negligence, including but not limited to sharing your password, leaving your account logged in on a public device, or failing to secure your own devices.

4. Acceptable Use Policy

You agree to use our Services only for lawful educational purposes. You must NOT:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others, including privacy and intellectual property rights
  • Attempt to gain unauthorized access to any part of the Services or other users' accounts
  • Transmit viruses, malware, or any other harmful code
  • Use automated systems to access the Services without authorization
  • Harass, abuse, or harm other users
  • Share content that is offensive, inappropriate, or contrary to Islamic values

5. Role-Based Access

Access to information and features is determined by your role:

Administrators

Full management capabilities within their school only. Cannot access other schools' data.

Teachers

Access limited to assigned classes and related student information.

Parents

View-only access to their own children's academic data.

Students

Access to their own assignments and educational materials.

Managers

Broad administrative access within their school, equivalent to an Administrator, except financial management (budget and expenses) is excluded.

Treasurers

Access limited to financial data (budget and expenses), student records, academic calendar, and school communications. No access to academic management, reports, or school settings.

6. Intellectual Property

The Services and all content, features, and functionality are owned by Qaf School App and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit to the Services. By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Services.

7. Termination

We reserve the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we believe:

  • Violates these Terms of Use
  • Harms other users or the platform
  • Exposes us to legal liability

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

Free Service Disclaimer: You acknowledge that the Services are provided free of charge (or at a nominal cost) and therefore you agree that Qaf School App shall have no liability to you for any data loss, data corruption, or security breaches. You are solely responsible for backing up your data.

9. Limitation of Liability

To the fullest extent permitted by law, Qaf School App shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Services. Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you have paid to us for the Services in the past twelve (12) months, or one hundred US dollars ($100), whichever is less.

10. Indemnification

You agree to defend, indemnify, and hold harmless Qaf School App, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

11. Force Majeure

Qaf School App shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Qaf School App's reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference), acts of God, war, terrorism, requirements of any governmental or transnational authority, or other "force majeure" events.

12. Dispute Resolution

Jurisdiction Notice: The arbitration and class action waiver provisions below apply only to users located in the United States. Users in the United Kingdom, European Union (including France), India, Australia, and other jurisdictions retain all rights to bring claims before their local courts under applicable mandatory consumer protection laws, regardless of any contrary provision in these Terms.

Binding Arbitration (US users only): Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver (US users only): You and Qaf School App agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

13. Changes to Terms

We may update these Terms of Use from time to time. We will notify you of significant changes by posting the new terms on our website and updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Virginia, United States, without regard to its conflict of law provisions.

Mandatory Local Laws: Nothing in these Terms limits or excludes any rights or remedies you have under mandatory applicable local law that cannot be waived by contract. In particular:

  • UK users: retain all rights under the Consumer Rights Act 2015 and other UK consumer protection legislation.
  • EU users (including France): retain all rights under EU consumer protection directives, the French Code de la consommation, and other applicable EU member state laws.
  • Australian users: retain all rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
  • Indian users: retain all rights under the Consumer Protection Act 2019 and other applicable Indian laws.

15. AI Assistant (“Qahwat Qaf”)

Qaf offers an optional AI assistant (“Qahwat Qaf”), including a chat interface and a live voice mode, to help you navigate and interact with the platform. This feature is disabled by default and only activates once you supply your own Google AI Studio API key (“bring your own key”, or BYOK).

  • Third-party processing, not ours: Your API key connects your account directly to Google's Gemini API under your own Google account. That processing is governed by Google's own terms and privacy policy, not by Qaf. We are not a party to, and accept no responsibility for, Google's handling of requests made with your key.
  • AI output may be wrong: The assistant can produce inaccurate, incomplete, or misleading responses (“hallucinations”). It is provided for convenience only and must not be relied upon for academic, financial, medical, safety-critical, or other consequential decisions without independent verification.
  • You are responsible for AI-driven actions: Depending on your role, the assistant may take actions on your behalf within the platform (for example, creating a student or teacher record, or updating class assignments) in response to your instructions. You are responsible for reviewing any record the assistant creates or modifies, and Qaf is not liable for errors or unintended changes resulting from AI-driven actions taken at your direction.
  • Voice mode: If you enable the live voice mode, your microphone audio is streamed to Google's Gemini Live API using your own API key for processing. Do not enable voice mode in settings where confidential conversations could be overheard or where you do not wish audio to be transmitted to Google.
